How to learn Brazilian legal and notarial Portuguese: a practical guide for translators

Learn Brazilian legal and notarial Portuguese with key formulas, notarial vocabulary, annotated examples, and a practice exercise for sworn translation.

Introduction

Searches like "Brazilian legal Portuguese," "notarial Portuguese for translators," or "how to translate deeds into Portuguese" usually come from people who already speak Portuguese — but not the kind found in escrituras, procurações, or court filings.

Brazilian legal and notarial Portuguese is a formal register with fixed formulas, institutional roles, and document-specific verbs. A fluent speaker can still produce versions that sound like everyday language when the source text requires a notarial or judicial effect. That gap matters for sworn translation, for the Brazilian public translator exam (TIPS), and for anyone working with Brazilian corporate, property, or succession documents.

This guide focuses on what English-speaking learners should study first: document function, recurring formulas, and the notarial vocabulary that does not map word for word from English.

Why Brazilian legal Portuguese is not "good Portuguese"

The mistake is treating legal Portuguese as elevated everyday language. In practice, it is closer to a set of document conventions.

Function before vocabulary

Before choosing a term, ask what the sentence does:

  • Does it identify a party (outorgante, comparecente, herdeiro)?
  • Does it grant or limit powers (outorgar poderes, revogar)?
  • Does it certify an act (certifica que, lavrada em)?
  • Does it describe property or succession (imóvel, legatário, usufruto)?

English legal writing uses its own formulas (hereby, whereas, in witness whereof). Brazilian Portuguese has parallel structures that are often shorter but no less conventional: pelo presente instrumento, em testemunho do que, sem prejuízo de.

False friends from English

Macete: when you see a noun in English that names a document type (deed, power of attorney, articles of incorporation), look up the Brazilian document family first. The translation problem is usually institutional, not lexical.

Essential notarial and legal vocabulary

These terms appear constantly in escrituras, reconhecimentos, procurações, and registros públicos.

Formulas that English speakers mishandle

"Pelo presente instrumento"

Standard opening in contracts, powers of attorney, and deeds. It does not need a literal mirror of "by this instrument." Common renderings when translating into English: "by this instrument," "hereby." When reading Portuguese sources, recognize it as a formal act marker, not padding.

"Certifica que"

Used by notaries and certifying authorities. In English: "certifies that." The subject is often the official (O Tabelião certifica que...).

"Lavrada em"

For deeds and notarial acts, lavrada means the instrument was drawn up and executed before the notary — not "washed" or "executed" in a corporate sense.

Example:

A escritura foi lavrada em 12 de março de 2024.

Good English:

The deed was executed on March 12, 2024.

Comment: In US English, executed works for deeds. In sworn translation into Portuguese, reverse the logic: prefer lavrada or outorgada, not executada.

"Em testemunho do que"

Closing formula. English equivalent: in witness whereof. Do not omit it in formal documents when the source includes a attestation block.

"Sem prejuízo de"

Means an action or right continues without affecting another. English: without prejudice to, without affecting. Very common in contracts and corporate acts.

How to study Brazilian legal Portuguese effectively

A 30–45 minute session might look like this:

  1. Pick one document type — power of attorney, deed of sale, corporate filing, or will.
  2. List roles — who grants, who receives, who certifies, who registers.
  3. Collect formulas as blocks — not single words. Example: confere poderes amplos e irrestritos = "grants broad and unrestricted powers."
  4. Translate timed both ways — TIPS and sworn work require PT→foreign and foreign→PT.
  5. Review by function — obligation, authorization, certification, condition.

On TreinoProva, categories aligned with the TIPS syllabus — including powers of attorney, notarial deeds, and corporate acts — let you drill vocabulary in document context rather than isolated flashcards.

Practical examples

Power of attorney

English:

The Principal hereby grants the Attorney-in-Fact full power and authority to represent him before banks and public agencies.

Adequate Brazilian legal Portuguese:

O Outorgante, pelo presente instrumento, confere ao Procurador plenos poderes e autoridade para representá-lo perante bancos e órgãos públicos.

Comment: Principal → Outorgante; Attorney-in-Fact → Procurador; before → perante, not "antes de."

Notarial certification

English:

The Notary Public certifies that the foregoing deed was executed by the parties in his presence.

Adequate Brazilian legal Portuguese:

O Tabelião certifica que a escritura supracitada foi lavrada pelas partes em sua presença.

Comment: foregoing deed → escritura supracitada; executed in notarial context → lavrada.

Property deed excerpt

English:

The property described herein is free and clear of all encumbrances, subject to the registration number stated below.

Adequate Brazilian legal Portuguese:

O imóvel descrito no presente instrumento encontra-se livre e desembaraçado de quaisquer ônus, observado o número de matrícula indicado abaixo.

Comment: herein → no presente instrumento; encumbrances → ônus; registration number in real estate → often matrícula.

Exercise

Translate into Brazilian legal Portuguese:

The Grantor hereby appoints the Agent to sign, acknowledge and deliver any documents necessary for the sale of the property described herein.
See answer

O Outorgante, pelo presente instrumento, nomeia o Procurador para assinar, reconhecer e entregar quaisquer documentos necessários à venda do imóvel descrito no presente instrumento.

Grantor is Outorgante. Agent in a power of attorney is usually Procurador, not "agente." Acknowledge may require reconhecer (formal signature acknowledgment) depending on the legal system. Herein points to the instrument: no presente instrumento. Property in real estate contexts is commonly imóvel.

Conclusion

Learning Brazilian legal and notarial Portuguese means learning document roles, fixed formulas, and institutional vocabulary — not just adding formal adjectives to sentences you already know. English speakers progress faster when they study by document type (procuração, escritura, testamento, ato societário) and review mistakes by function: party identification, power grant, certification, registration.
